Prior “No objection certificate” withdrawn for Armed forces.

Tuesday, July 28:In accordance to pertain an order of “No objection Certificate” from the Home Department for acquisition of land in Jammu and Kashmir, Revenue Department has recently withdrawn the order earlier mandated to armed forces in Jammu and kashmir.
A circular has been issued withdrawing the previous circular of Revenue Department (LB) 71/13 dated August 27,1971 by Dr Pawan Kotwal ,Principle Secretary, Revenue department .Prior to this ,the Armed forces /BSF/CRPF and similar organizations in Jammu and Kashmir had to take no objection certificate from the Home department for acquisition of land in the region.
“in view of the extension of Right to Fair Compensation and Transparency In land acquisition, Rehabilitation and Resettlement Act,2013 to the Union Territory of Jammu and Kashmir, the circular number Rev 71/13-A of August 27,1971 which prescribed obtaining No Objection Certificate from the Home department for acquisition/ requisition of land in favour of the Army,BSF,CRPF and similar organizations is withdrawn”, cited the circular issued by the Revenue Department.
To implement the order on fast track bases, the circular has given clear instructions to all Collectors Land Acquisition designated under the Fair Compensation and Transparency In land Acquisition, Rehabilitation and Resettlement Act,2013 and the Competent Authority land Acquisition(CALA) authorized under the National Highway act,1956 to deal with cases of land acquisition/requisition as per these two new Acts and Rules.
