The High Court of Jammu and Kashmir has issued notice to CEO of MC Kupwara for alleged violation of the court order dated 15-09-2022 in a petition filed by the Intizamia Committe Markazi Jamia Masjid Kupwara.Advocate Sheikh Manzoor appearing for the petitioners said that the Municipal Committee Kupwara after sport verification and completing all legal formalities had issued a building permission on 22-08-2022 to the petitioners for reconstruction of decades old commercial shopping complex situated near Jamia Masjid Kupwara. However, subsequently on 31-08-2022 a notice was issued to the petitioners by CEO MC Kupwara and directed the petitioners to stop the work. The petitioners approached the Hon’ble High Court of J and ak Srinagar and a direction was passed to CEO MC Kupwara to allow the petitioners to continue the construction work in accordance with the permission.Sheikh further said that on 30-08-2022 an order was passed by J&K special Tribunal Srinagar whereby the operation of the reconstruction persission issues by CEO MC Kupwara was atayed. After this order the CEO MC Kupwara directed the field agencies to implement the order of Special Tribunal and not the Hon’ble High Court. On the allegations of disobeying the Order of Hon’ble High Court by the CEO MC Kupwara , the petitioners filed the contempt of court petition against CEO MC Kupwara and while issuing notice the court directed him to file statement of facts.
